In an opinion released today, the Second Circuit upheld the class action certification and settlement with Jenkens & Gilchrist arising out of tax shelters allegedly devised with Deutsche Bank and allegedly marketed by BDO Seidman, but held that that the contribution and indemnity provisions insufficiently protect the rights of nonsettling defendants and third parties.
