ABA Again Rejects Florida Coastal’s Teach-Out Plan, Finds Sixth School Back In Compliance With 75% Bar Passage Within 2 Years Accreditation Standard

ABA Section of Legal Education and Admissions to the Bar, Notice of Council and Executive Committee Decision: Florida Coastal School of Law Teach-Out Plan (May 18, 2021):

Florida Coastal (2017)At a meeting on May 13-15, 2021, the Council of the Section of Legal Education and Admissions to the Bar of the American Bar Association (the “Council”) and its Executive Committee considered the Teach-Out Plan submitted by the Florida Coastal School of Law (the “Law School”).

After careful review of the Law School’s submission, the Council and the Executive Committee rejected the Teach-Out Plan as filed because the plan did not include sufficient detail relating to the operation of a teach-out in light of the U.S. Department of Education’s denial of the Law School’s application for reinstatement to participate as an eligible institution in the student financial assistance programs authorized pursuant to Title IV of the Higher Education Act of 1965.

As provided by Rule 29(k)(2), the Law School is directed to revise and resubmit the Teach-Out Plan on or before May 28, 2021. The revised Teach-Out Plan will be considered by the Executive Committee of the Council at a date to be determined.

ABA Section of Legal Education and Admissions to the Bar, Council Decision Decision Notice of Law School Demonstrating Compliance With Standard 316: Mississippi College School of Law (May 18, 2021):

Mississippi College of Law (2021)At its May 13-15, 2021, meeting, the Council of the Section of Legal Education and Admissions to the Bar of the American Bar Association (the “Council”) considered the status of Mississippi College School of Law (the “Law School”) regarding its noncompliance with Standard 316.

Following consideration of the record in the matter and the Law School’s response to the Council’s May 2020 and February 2021 Decision Letters, the Council concluded that the information provided by the Law School is sufficient to demonstrate compliance with Standard 316. Accordingly, the Rule 13(a)(2) hearing is cancelled in accordance with Rule 20(d). Mississippi College School of Law remains an approved law school.

ABA Journal, Florida Coastal’s Teach-Out Plan Rejected Again; Another School Demonstrates Compliance on Bar Pass Rates:

For the second time in a month, the council and an executive committee of the ABA’s Section of Legal Education and Admissions to the Bar has rejected a teach-out plan submitted by the Florida Coastal School of Law. …

Mississippi College School of Law has demonstrated compliance with Standard 316, which requires a bar passage rate of at least 75% within two years of graduation.

The law school’s two-year bar passage rate was 72.64% for 2017 graduates and 73.83% for 2018 graduates. For 2019 graduates, the pass rate was 79.2%, Patricia Bennett, the law school’s dean, recently told the ABA Journal.
