The University of Idaho is facing a third lawsuit over its College of Law, this time from students who say professors and other students discriminated against them for their race and LGBTQ identity and the administration didn’t properly investigate.

The plaintiffs in the federal lawsuit, referred to as Kelly, Jane, and John Doe, claim a pattern of discrimination and harassment based on their sexual orientation and disabilities. The suit says when combined with what they call the university’s weak response to the harassment, it made the students feel unsafe while pursuing their JDs at the Moscow campus. Kelly, Jane, and John — who each belong to a minority group and identify as members of the LGBTQ community — all eventually left Idaho and Jane ended up transferring schools. They are suing the school and multiple people within the university for compensatory damages.

The plaintiffs claim they received significant harassment from a group of students involved in the school’s Christian Legal Society chapter who filed a free speech lawsuit in 2022 against UI. The federal lawsuit claims CLS is opposed to same-sex marriage, LGBTQ relationships, and its members believe religious organizations should be allowed to discriminate against individuals based on sexual orientation and gender identity.

It also details multiple incidents in which the plaintiffs said they were harassed, maligned, and discriminated against while attending UI’s College of Law. The suit claims the incidents include racist comments made in class, a CLS student attacking and outing John at a party, and a professor telling LGBTQ students they are going to hell and providing an anti-LGBTQ hate group with Jane’s contact information. The suit says the incidents happened between 2021 and 2023.

This is not the first time the University of Idaho College of Law has been accused of discrimination. Shaakirrah Sanders is a former law professor at the school and the university’s first Black woman to become a full professor with the College of Law. She sued the University of Idaho in 2019 because she was “subjected to insulting, humiliating and/or discriminatory conduct related to her gender or race.” … 

Idaho Education News reported that in September, Sanders and the school reached a $750,000 settlement. She has since moved to Penn State’s law program.
