Having already suspended its accreditation rule requiring law schools to demonstrate a commitment to diversity in admissions, student recruitment and programming, the ABA Council took the next step in potentially eliminating the rule altogether when the Council voted, pending a notice and comment period, to suspend the rule through August 2027.. The Council’s principal rationale is that the plethora of state laws governing admissions and other aspects of higher education make enforcement of the previous Standard 206 simply impracticable. Law schools, the Council reminds us, remain free to pursue the underlying values behind the now suspended diversity requirement.
