The Harvard Crimson reports that a group of conservative federal judges are once again wreaking havoc with the idea that clerkship hiring should be delayed until a fixed deadline. Judges for decades have attempted, abandoned and attempted again to set a date to level the playing field and bring order to the process for overworked students. This time it’s conservative judges running roughshod over rules, apparently now hiring Harvard 1L’s. Some students have offered the absurd excuse that the are too few conservative students (as if one’s clerks have to agree with judges on partisan lines) But let’s be clear, judges of all stripes have made a mockery of a hiring deadline for years. It’s a horrible example of greed over fairness that those on the bench are setting for the nation’s law students. The Federalist Society should condemn the latest excesses.
