Renowned political commentator Josh Marshall, of Talking Points Memo, offers an iconclastic take on how we got to the point where Supreme Court justices are taking inappropriate gifts and reaching unjust outcomes. He notes the trend over many decades of professionalizing the bench through dominance of elite law schools and wonders aloud if law faculty eager to cling to our perch as purveyors and owners of specialized knowledge have mystified the law for our own ends. Such elite dominance Marshall suggests sends the message to ordinary people that understanding the law and the constitution should be left to the experts. I don’t see all the connections he does, but we should certainly know what’s being said about us in such prominent places.
