Following up on yesterday’s post, Judge Preparing to Dismiss KPMG Case?, today’s New York Law Journal picks up the story in Federal Judge Schedules Hearing on Dismissal of KPMG Tax Case, by Beth Bar:

Taking their cue from a recent federal appellate decision, former KPMG employees involved in what is said to be the largest criminal tax case in U.S. history are pressing to have the case dismissed. Southern District of New York Judge Lewis Kaplan, in an order released Thursday, said the defendants had advised him on May 24 that they would move "promptly" for dismissal of the charges that they created illegal tax shelters for clients. Kaplan gave the 16 former KPMG partners and employees until next Friday to file any motions. The government then will have until June 22 to reply. A hearing will be held on July 2.
