In Seippel v. Jenkins & Gilchrist, No. 03 Civ. 6942 (SAS) (S.D.N.Y. Aug. 25, 2004), the district court refused to dismiss a taxpayer’s fraud and recission claims against Sidley Austin over its role in recommending the COBRA tax shelter.
