Boston Globe, Congressman Tierney’s Wife to Admit to Tax Fraud:
The wife of US Representative John F. Tierney is poised to plead guilty today to federal tax charges for managing a bank account that her brother allegedly used to deposit millions of dollars in illegal gambling profits raked in from an offshore sports betting operation in Antigua.

Tierney is accused only of mislabeling her brother’s income. “Tierney provided information to Eremian’s tax preparer that mischaracterized Eremian’s income as commissions and Eremian’s employment as a computer consultant.” There’s no suggestion in the US Attorney’s statement that there was any underreporting of income or underpayment of tax. Is this really ‘fraud’?
If Al Capone had reported all of his income but labeled it correctly as bootlegging, gambling, and extortion, would he have been innocent of tax evasion but have given up his Fifth Amendment right against self-incrimination?

In the context of tax crimes, the Fifth Amendment privilege against self-incrimination does not apply unless the individual makes a Sullivan disclosure. United States v. Sullivan, 274 U.S. 259 (1927).
